Uninsured and Underinsured Motorist Coverage in California

What to compare in your policy

Read uninsured motorist (UM) and underinsured motorist (UIM) bodily-injury limits separately from vehicle-damage coverage. Ask how payments from the responsible driver reduce the available UIM amount.

Uninsured motorist coverage can respond when a covered person is injured by a driver with no liability insurance. Underinsured motorist coverage may apply when the at-fault driver's limit is insufficient for the covered damages.

Coverage for injuries differs from coverage for vehicle damage. California's UIM rules restrict adding policy limits together, and the contract and law determine who qualifies as an insured. Collision coverage may still be important for vehicle damage.

Review every household driver, regular passenger exposure, medical-insurance deductibles, income, and liability limits. Rejecting or reducing UM/UIM can materially shift accident risk back to the household.

Whose injuries are we talking about?

Your liability insurance addresses covered injuries you cause to others. UM/UIM bodily-injury coverage addresses covered injuries to insured people when another driver is responsible but lacks sufficient insurance. Medical bills and lost earnings are different losses; having health insurance does not make those two coverages identical.

California UIM is not simply an extra limit stacked on top of the other driver's payment. Illustrative example: with $100,000 of applicable UIM coverage and $30,000 paid by the responsible driver's insurer, the potential remaining UIM limit is $70,000, not another $100,000. Actual recovery depends on covered damages and policy/legal requirements, including exhaustion and offsets.

Do not confuse injury protection with car repairs

Uninsured-motorist property damage has different conditions from collision; identification of the uninsured driver matters. A hit-and-run vehicle-damage claim is not automatically covered just because UM appears on your declarations. Ask us to explain bodily injury, vehicle damage, collision, and any collision-deductible waiver separately, including how to report an accident promptly and preserve the information your insurer needs.
